In 1853, the California legislature made Sutter a Major General in the California Militia.[48]. He was drafted 11th overall, the highest of the second-generation Sutters, in the 2007 NHL Entry Draft by the Carolina Hurricanes, and became the first of the second generation to play in the NHL. The battle consisted primarily of an artillery exchange, and during the battle Marsh secretly went over to parley with the other side. All the Indians of the attacked village naturally fled to find protection on the other bank of the river. John Augustus Sutter (1803 1880) was a Swiss-American pioneer of California known for his association with the California Gold Rush, and for establishing Sutter's Fort in the area that would eventually become Sacramento, the state's capital.
